4. Records Held, by Subject and Category

  • Company and governance: MOI, CIPC filings, shareholder and director records, resolutions, statutory registers
  • Finance and tax: accounting records, annual financial statements, bank statements, invoices, tax returns (VAT, PAYE, income tax)
  • Operations and IT: system logs, backups, access controls, security policies, POPIA section 17 processing records
  • Commercial: own employee, client, client-payroll, supplier and marketing records (personal information categories described in section 6)

Records are kept in accordance with the Companies Act 71 of 2008, Income Tax Act 58 of 1962, Tax Administration Act 28 of 2011, Value-Added Tax Act 89 of 1991, Basic Conditions of Employment Act 75 of 1997, Labour Relations Act 66 of 1995, Skills Development Levies Act 9 of 1999, Unemployment Insurance Act 63 of 2001, Unemployment Insurance Contributions Act 4 of 2002, Compensation for Occupational Injuries and Diseases Act 130 of 1993, Protection of Personal Information Act 4 of 2013, and Promotion of Access to Information Act 2 of 2000.

6. POPIA Information (Section 51(1) read with POPIA)

Categories of data subjects and information processed

  • Own employees: identity, contact, banking, tax, employment and payroll details
  • Clients and their representatives: business and contact details, signatory details, billing details
  • Employees of clients whose payroll we process: identity, contact, banking, tax, salaries, deductions, leave, dependant information where provided
  • Suppliers: business, contact and banking details
  • Website visitors and prospects: name, contact details, IP addresses, website analytics data

Recipients

SARS, Department of Employment and Labour, UIF, Compensation Fund and other regulators where required by law; banks and financial institutions for executing salary and statutory payments; auditors, accountants and other professional advisors; cloud and IT service providers under operator agreements.

Transborder flows

Personal information may be processed by cloud service providers located outside South Africa, in compliance with section 72 of POPIA.

Security measures

Role-based access controls, encryption in transit and (where appropriate) at rest, authentication controls, backups and disaster recovery, employee and contractor confidentiality undertakings, and operator agreements binding third parties to POPIA-equivalent obligations.

Requests must be made on Form 02 (Regulation 7) of the PAIA Regulations, available at https://inforegulator.org.za, and sent to info@superpayroll.co.za. Fees are as prescribed in Annexure B of the PAIA Regulations.
